ข้อกำหนดและเงื่อนไขการเติมเงินเกมแบบ พี2ดับเบิ้ลยู

1. คำจำกัดความ

บริษัท เปย์ ทู วิน จำกัด (โดยในบางกรณีอาจเรียกว่า "พี2ดับเบิ้ลยู" หรือเรียกอีกอย่างว่า "พี2ดับเบิ้ลยู ท็อปอัพ") เป็นบริษัทที่มีส่วนธุรกิจที่ดำเนินการในการให้บริการเติมเงิน พี2ดับเบิ้ลยูท็อปอัพ ผ่านทางเว็บไซต์ www.p2wtopup.com ซึ่งเป็นเว็บไซต์ที่ตอบสนองความต้องการต่างๆ ของผู้ใช้ในด้านที่เกี่ยวข้องกับการ เล่นเกม

ข้อกำหนดและเงื่อนไขต่าง ๆ อ้างอิงถึงสัญญาฉบับนี้ระหว่างผู้ใช้งานจริงและ พี2ดับเบิ้ลยูท็อปอัพ ซึ่งประกอบด้วยกฎเกณฑ์หนึ่งชุดที่ควบคุมด้านสิทธิ ภาระผูกพัน ความรับผิดชอบของผู้ใช้และ พี2ดับเบิ้ลยู ท็อปอัพ และขั้นตอนในการใช้บริการ พี2ดับเบิ้ลยูท็อปอัพ (โดยในบางกรณีอาจเรียกว่า "บริการ")

กำหนดให้คำว่า เรา ของเรา หรือ ต่อเรา หมายความถึง พี2ดับเบิ้ลยูท็อปอัพ

ท่านหรือของท่าน ในสัญญาฉบับนี้ หมายความถึง บุคคล หรือองค์กรใดๆ ที่ยอมรับข้อตกลงในสัญญาฉบับนี้ หรือมีสิทธิ์เข้าถึงบัญชีของท่านได้ หรือใช้บริการหรือเว็บไซต์ หรือสั่งซื้อบริการต่าง ๆ ซึ่ง อาจใช้คำว่า ผู้ใช้งานจริง แทนการใช้คำว่า ท่าน ภายใต้ข้อกำหนดและเงื่อนไขในสัญญาฉบับนี้ได้

ผู้ใช้งานจริงหรือลูกค้า หมายความถึง ผู้ใช้งานจริงที่ซื้อผลิตภัณฑ์จากผู้ขายผ่านทาง พี2ดับเบิ้ลยูท็อปอัพ

คำสั่งซื้อ หมายถึง คำสั่งซื้อผลิตภัณฑ์ที่ท่านได้ทำการสั่งซื้อ

บริการต่าง ๆ หรือ บริการ พี2ดับเบิ้ลยูท็อปอัพ หมายถึง บริการที่จัดทำให้โดย พี2ดับเบิ้ลยูท็อปอัพ เพื่อช่วยเหลือ และอำนวยความสะดวกให้ผู้ใช้งานจริงสามารถทำการซื้อของ ชำระเงิน และรับสินค้าจากผู้ขายได้

เว็บไซต์นี้เป็นเว็บไซต์ พี2ดับเบิ้ลยูท็อปอัพ ที่สามารถเข้าถึงได้ผ่าน https://www.p2wtopup.com

ผู้ขาย หมายถึง เจ้าของผลิตภัณฑ์ที่จำหน่ายผ่าน พี2ดับเบิ้ลยูท็อปอัพ ซึ่งผู้ใช้งานจริงสามารถซื้อโดยตรงและดำเนินธุรกรรมโดยตรงกับผู้ขายได้

ผลิตภัณฑ์ หมายถึง ผลิตภัณฑ์ และบริการบนเว็บไซต์ซึ่ง พี2ดับเบิ้ลยูท็อปอัพ เป็นฝ่ายอำนวยความสะดวกในการขายผลิตภัณฑ์ต่าง ๆ ให้ เช่น การเติมเงินเกม และผลิตภัณฑ์ต่าง ๆ ที่เกี่ยวข้องอื่นๆ โดยผู้ขายให้กับผู้ใช้งานจริงเท่านั้น นอกจากนี้ยังมีผลิตภัณฑ์บางประการที่ พี2ดับเบิ้ลยูท็อปอัพ เป็นฝ่ายจัดทำให้บริการเอง เช่น แพ็คเกจข้อมูลเกม การสมัครรับเกม และเกมบนคลาวด์ เป็นต้น

2. การใช้บริการทั่วไป

ท่านตกลงในการปฏิบัติตามแนวทาง ประกาศ กฎเกณฑ์ในการปฏิบัติงาน และนโยบายและคำแนะนำทั้งหมดที่เกี่ยวข้องกับการใช้งานบริการและ/หรือการเข้าถึงเว็บไซต์ รวมถึงการแก้ไขใดๆ ในข้อที่กล่าวถึงข้างต้น ซึ่งออกโดยบริษัทเราเป็นครั้งคราว อนึ่ง เราขอสงวนสิทธิ์ในการแก้ไขแนวทาง ประกาศ กฎการปฏิบัติงาน และนโยบายและคำแนะนำเหล่านี้ตลอดเวลา และถือว่าท่านได้รับทราบและยินยอมผูกพันตามการเปลี่ยนแปลงใดๆ ที่เกิดขึ้นข้างต้นเมื่อมีการเผยแพร่บนเว็บไซต์

2.1 ท่านตกลงและยินยอมที่จะไม่:

ก) นำ พี2ดับเบิ้ลยูท็อปอัพ ไปใช้ในทางใดๆ อันเป็นการละเมิดต่อกฎหมายใดๆ ที่บังคับใช้อยู่หรือเพื่อวัตถุประสงค์ใด ๆ ที่ผิดต่อกฎหมาย

ข) พยายามที่จะทำให้เกิดความเสียหาย ขัดขวาง หรือมีส่วนร่วมในกิจกรรมใดๆ ที่ทำให้ พี2ดับเบิ้ลยูท็อปอัพ เว็บไซต์ของเรา หรือบริการของเราเสื่อมเสีย

ค) ขัดขวางมิให้บุคคลอื่นใช้งาน พี2ดับเบิ้ลยูท็อปอัพ

ง) แสดงตัวตนอันเป็นเท็จหรือปลอมแปลงเป็นบุคคลหรือองค์กรอื่น รวมถึงแต่ไม่จำกัดเฉพาะผู้ใช้เว็บไซต์นี้ กรรมการ เจ้าหน้าที่ พนักงาน ผู้ถือหุ้น ตัวแทน หรือผู้แทนของ พี2ดับเบิ้ลยูท็อปอัพ บริษัทในเครือของเรา หรือบุคคลหรือองค์กรอื่นใด หรือระบุเป็นเท็จหรือแสดงตนเป็นเท็จเกี่ยวกับความเกี่ยวข้องของคุณกับ พี2ดับเบิ้ลยูท็อปอัพหรือบริษัทในเครือของเรา หรือบุคคลหรือองค์กรอื่นใด

จ) หรือควบคุมสิทธิ์ในเนื้อหาดังกล่าวหรือได้รับความยินยอมทั้งหมดที่จำเป็นแล้ว

ฉ) ใช้ พี2ดับเบิ้ลยูท็อปอัพ เพื่อเก็บเกี่ยวหรือรวบรวมข้อมูลเกี่ยวกับผู้อื่น รวมถึงที่อยู่อีเมลต่าง ๆ

ช) พยายามที่จะปรับเปลี่ยน แปล ดัดแปลง แก้ไข คัดลอก แยกชิ้นส่วน ถอดประกอบ หรือทำการค้นหาโครงสร้าง

ซ) การทำงานของซอฟท์แวร์ใด ๆ ที่ พี2ดับเบิ้ลยูท็อปอัพ ได้นำมาใช้หรือจัดจำหน่าย

ฌ) ใช้ความพยายามในการเข้าถึงบัญชี คอมพิวเตอร์ หรือเครือข่ายใดๆ ที่เกี่ยวข้องกับ พี2ดับเบิ้ลยูท็อปอัพ โดยไม่ได้รับอนุญาต

ญ) พยายามที่จะรับข้อมูลใดๆ ผ่านวิธีการใดๆ จาก พี2ดับเบิ้ลยูท็อปอัพ ยกเว้นในกรณีที่เราตั้งใจให้บริการหรืออำนวยให้ข้อมูลดังกล่าวพร้อมใช้งานสำหรับท่าน

ฎ) พยายามเรียกเก็บเงินจากผู้อื่นในการใช้ พี2ดับเบิ้ลยูท็อปอัพ ไม่ว่าทางตรงหรือทางอ้อมก็ตาม

ฏ) ใช้ พี2ดับเบิ้ลยูท็อปอัพ เพื่อการหมิ่นประมาท การดูหมิ่น การคุกคาม การสะกดรอย การคุกคาม หรือการละเมิดสิทธิตามกฎหมายของผู้อื่นในรูปแบบอื่นใดก็ตาม

ฐ) ใช้ พี2ดับเบิ้ลยูท็อปอัพ เพื่อซื้อสื่อใดๆ ที่ได้รับการคุ้มครองโดยกฎหมายว่าด้วยทรัพย์สินทางปัญญา เว้นแต่ท่านจะเป็นเจ้าของเว็บไซต์นี้เพื่อทำร้ายผู้เยาว์ในทางใดๆ หรือเรียกร้องหรือพยายามอื่นๆ เพื่อรับข้อมูลใดๆ จากผู้เยาว์

ฑ) กระทำในลักษณะใด ๆ ที่ส่งผลกระทบเชิงลบหรือเป็นการลดทอนคุณภาพประสบการณ์ของผู้ใช้งานรายอื่นบนเว็บไซต์นี้

2.2 บริษัทเราอาจทำการอัพเกรด แก้ไข ระงับ หรือหยุดการให้บริการ หรือลบ ไม่ว่าทั้งหมดหรือบางส่วนของไซต์หรือบริการใดๆ เป็นครั้งคราว โดยไม่ต้องให้เหตุผลหรือแจ้งให้ทราบล่วงหน้า และจะไม่รับผิดชอบหากการอัพเกรด แก้ไข ระงับ หรือลบดังกล่าวทำให้คุณไม่สามารถเข้าถึงไซต์หรือส่วนใดๆ ของบริการได้

2.3 ท่านยินยอมที่จะไม่เปลี่ยนแปลง แก้ไข ทำซ้ำ จำลอง คัดลอก ขาย ขายต่อ หรือแสวงประโยชน์จากส่วนใดส่วนหนึ่งของบริการ การใช้บริการ หรือการเข้าถึงบริการโดยมิได้รับอนุญาตเป็นลายลักษณ์อักษรโดยชัดแจ้งจาก พี2ดับเบิ้ลยูท็อปอัพ

2.4 บริษัทเราขอสงวนสิทธิ์โดยดุลยพินิจแต่เพียงผู้เดียวแต่จะไม่ผูกพันในการ

ก) ตรวจสอบ คัดกรอง หรือควบคุมกิจกรรม เนื้อหา หรือสื่อใดๆ บนเว็บไซต์และ/หรือผ่านทางบริการต่างๆ โดยที่บริษัทเราอาจใช้ดุลยพินิจแต่เพียงผู้เดียวในการตรวจสอบการละเมิดข้อกำหนดและเงื่อนไขใด ๆ ที่มีอยู่ในสัญญาฉบับนี้ และอาจดำเนินการใด ๆ ที่เห็นว่าเหมาะสมได้

ข) ป้องกันหรือจำกัดการเข้าถึงของผู้ใช้งานจริงใด ๆ ในการเข้าใช้เว็บไซต์และ/หรือบริการต่าง ๆ

ค) รายงานกิจกรรมใดๆ ที่บริษัทเราสงสัยว่าเป็นการละเมิดกฎหมาย ระเบียบข้อบังคับ หรือกฎเกณฑ์ใดๆ ที่บังคับใช้อยู่ให้หน่วยงานที่เกี่ยวข้องทราบ และให้ความร่วมมือกับหน่วยงานดังกล่าว และ/หรือ

ง) ขอข้อมูลและเนื้อหาใด ๆ จากท่านในส่วนที่เกี่ยวข้องกับการใช้งานบริการและ/หรือการเข้าถึงเว็บไซต์ของท่านได้ตลอดเวลา และใช้สิทธิ์ของเราภายใต้ย่อหน้านี้ในกรณีที่ท่านปฏิเสธที่จะเปิดเผยข้อมูลและ/หรือเนื้อหาดังกล่าวหรือในกรณีที่ท่านให้หรือหากบริษัทเรามีเหตุผลอันสมควรที่จะสงสัยว่าท่านได้ให้ข้อมูลและ/หรือเนื้อหาที่เป็นเท็จ อันส่อให้เข้าใจผิด หรือฉ้อโกง

จ) ปิดการใช้งาน ยกเลิก ลบ ห้าม ป้องกัน และจำกัดการเข้าถึงเว็บไซต์ และ/หรือ บริการของและโดยบัญชี พี2ดับเบิ้ลยูท็อปอัพ ใดๆ ผู้ใช้งานจริงและ/หรือบุคคลใดๆ ไม่ว่าจะถาวรหรือชั่วคราวก็ตาม และโดยไม่ต้องให้เหตุผลหรือแจ้งให้ทราบล่วงหน้าแต่อย่างใด

3. นโยบายความเป็นส่วนตัว

3.1 การใช้บริการและ/หรือการเข้าถึง พี2ดับเบิ้ลยูท็อปอัพ ของท่านอยู่ภายใต้เงื่อนไขความเป็นส่วนตัวตามที่ระบุไว้ที่ https://p2wtopup.com/policy เช่นกัน

4. บัญชีผู้ใช้งาน พี2ดับเบิ้ลยูท็อปอัพ

4.1 ผู้ใช้งานจริงขอรับรองว่าผู้ใช้งานจริงเป็นบุคคลที่มมีความสามารถและเป็นผู้มีสิทธิ์ตามกฎหมายในการเข้าผูกพันตามข้อตกลงทางกฎหมายได้

4.2 พี2ดับเบิ้ลยูท็อปอัพ จะไม่เรียกเก็บเงินจากผู้ใช้งานจริงสำหรับการลงทะเบียนการให้บริการของ พี2ดับเบิ้ลยูท็อปอัพ

4.3 ท่านจะต้องสร้างบัญชีผู้ใช้งานด้วยหมายเลขโทรศัพท์มือถือหรือที่อยู่อีเมลที่ใช้งานได้ในประเทศไทย และดำเนินการตรวจยืนยันให้ครบถ้วนก่อนเสร็จสิ้นการสั่งซื้อบนเว็บไซต์ พี2ดับเบิ้ลยูท็อปอัพ

4.4 ท่านยินยอมให้ พี2ดับเบิ้ลยู สามารถเปิดเผยและส่งต่อข้อมูลของท่านที่ให้ไว้ใน พี2ดับเบิ้ลยูท็อปอัพ ให้กับบุคคลที่สามที่เกี่ยวข้องในฐานะส่วนหนึ่งในการให้บริการแก่ท่านได้

5. เงื่อนไขการจัดจำหน่ายผลิตภัณฑ์

5.1 ท่านยอมรับว่า พี2ดับเบิ้ลยู ไม่ได้ขายหรือเป็นเจ้าของผลิตภัณฑ์ใดๆ บนเว็บไซต์โดยตรง และเป็นเพียงการอำนวยความสะดวกในการจัดจำหน่ายผลิตภัณฑ์โดยผู้ขายให้กับผู้ใช้งานจริงแต่เพียงเท่านั้น ซึ่งชื่อของผู้จัดจำหน่ายผลิตภัณฑ์จะปรากฏต่อสาธารณะบนเว็บไซต์

5.2 ผู้จัดจำหน่ายเป็นผู้ให้อนุญาตให้ท่านใช้ผลิตภัณฑ์ใดๆ ก็ตามนั้น ซึ่งไม่ใช่ พี2ดับเบิ้ลยู และอยู่ภายใต้ข้อกำหนดและเงื่อนไขการบริการใดๆ ตามที่ผู้จัดจำหน่ายได้จัดเตรียมเอาไว้ รวมถึงแต่ไม่จำกัดเพียงการรับประกัน (หากมี) การเป็นเจ้าของทรัพย์สินทางปัญญา และการใช้งานที่ได้รับอนุญาต อนึ่ง ข้อตกลงแต่ละข้อที่ทำขึ้นเพื่อการจัดจำหน่ายผลิตภัณฑ์ให้กับผู้ใช้งานจริงจะถือเป็นข้อตกลงที่ทำขึ้นโดยตรงและเฉพาะระหว่าง ผู้จัดจำหน่ายและผู้ใช้งานจริงแต่เพียงเท่านั้น และอยู่ภายใต้ข้อกำหนดและเงื่อนไขการขายที่ระบุไว้ในสัญญาฉบับนี้ด้วย

5.3 ท่านได้รับทราบและยินยอมว่าท่านมีหน้าที่ในการติดต่อผู้จัดจำหน่ายหรือตัวแทนที่ได้รับมอบหมายเกี่ยวกับปัญหาด้านบริการใดๆ รวมถึงปัญหาด้านการสนับสนุนต่าง ๆ โดยที่ พี2ดับเบิ้ลยู เป็นฝ่ายให้การสนับสนุนลูกค้าแก่ท่านโดยไม่คิดค่าธรรมเนียมเพิ่มเติมในการแก้ไขปัญหาด้านบริการที่เกี่ยวข้องกับการใช้ พี2ดับเบิ้ลยูท็อปอัพ

5.4 คำอธิบายสินค้า

ก) ในขณะที่บริษัทเราพยายามอย่างเต็มที่ในการให้คำอธิบายอย่างถูกต้องในด้านผลิตภัณฑ์ในหน้ารายละเอียดสินค้า ทว่าเราไม่ขอรับประกันว่าคำอธิบายดังกล่าวมีความถูกต้องสมบูรณ์ เป็นปัจจุบัน หรือปราศจากข้อผิดพลาดใด ๆ

5.5 ราคาของผลิตภัณฑ์ต่าง ๆ

ก) ราคาผลิตภัณฑ์ทั้งหมดจะต้องมีการเสียภาษี เว้นแต่จะมีการระบุไว้เป็นอย่างอื่นอย่างชัดเจน

ข) บริษัทเราขอสงวนสิทธิ์ในการแก้ไขราคาตามที่ผู้จัดจำหน่ายได้แจ้งและร้องขอเอาไว้ โดยไม่ต้องให้เหตุผลหรือแจ้งให้ทราบล่วงหน้าแต่อย่างใด

5.6 การสั่งซื้อ

ก) ท่านสามารถทำการสั่งซื้อได้โดยการกรอกแบบฟอร์มการสั่งซื้อบนเว็บไซต์และคลิกปุ่มยืนยัน โดยผู้จัดจำหน่ายจะไม่ยอมรับคำสั่งซื้อที่ดำเนินการด้วยวิธีอื่นใด ทั้งนี้ท่านมีหน้าที่รับผิดชอบในการรับรองความถูกต้องของคำสั่งซื้อ

ข) เมื่อได้รับการยืนยันการชำระเงินแล้ว คำสั่งซื้อจะไม่สามารถยกเลิกได้โดยไม่มีเงื่อนไขใด ๆ ซึ่งคำสั่งซื้อจะไม่สามารถย้อนกลับ คืนเงิน โอน และ/หรือยกเลิกได้ทั้งสิ้น

ค) พี2ดับเบิ้ลยูท็อปอัพ จะเป็นฝ่ายจัดทำใบแจ้งยอดค่าบริการที่เกิดขึ้นให้กับท่าน และท่านมีหน้าที่ในการชำระเงินตามข้อกำหนดและเงื่อนไขตามข้อ 12 โดยในกรณีนี้ ท่านยอมรับและตกลงว่าสินค้าจะถูกส่งมอบให้กับท่านเมื่อได้มีการชำระเงินเรียบร้อยแล้ว

ง) ราคาของผลิตภัณฑ์ต่าง ๆ ที่แสดงอยู่บนเว็บไซต์เป็นสกุลเงินท้องถิ่น

จ) ในกรณีที่ท่านไม่สามารถชำระเงินตรงเวลาได้ ท่านยอมรับว่า พี2ดับเบิ้ลยู อาจดำเนินการยกเลิกหรือระงับผลิตภัณฑ์ที่ได้รับผลกระทบ นอกเหนือจากสิทธิ์และการเยียวยาอื่นๆ ทั้งหมดที่มอบให้แก่ พี2ดับเบิ้ลยูท็อปอัพ ตามเอกสารฉบับนี้หรือตามกฎหมาย

6. การคืนเงิน

การทำธุรกรรมทั้งหมดที่เป็นการดำเนินการตามข้อกำหนดและเงื่อนไขต่าง ๆ เหล่านี้ถือเป็นที่สิ้นสุด ซึ่งผลิตภัณฑ์ที่จำหน่ายผ่าน พี2ดับเบิ้ลยูท็อปอัพ มีนโยบายไม่คืนเงินอย่างเคร่งครัด ทั้งนี้โปรดตรวจสอบว่าผลิตภัณฑ์ที่จะทำการชำระเงินนั้นเหมาะสำหรับคุณก่อนทำการสั่งซื้อ โดยที่ผู้ใช้งานจริงจะเป็นผู้รับผิดชอบการยืนยันว่าอุปกรณ์ของตนเข้ากันได้กับผลิตภัณฑ์ที่ซื้อแต่เพียงผู้เดียว ซึ่งการสั่งซื้อสินค้าเสมือนจริงทั้งหมดถือเป็นที่สิ้นสุด ไม่สามารถขอคืนเงินหรือส่งคืนได้ทั้งสิ้น บริษัทเราไม่เสนอการคืนเงินหรือการแลกเปลี่ยนสำหรับการสั่งซื้อผลิตภัณฑ์ที่ไม่ถูกต้องซึ่งเกิดจากพฤติกรรมของผู้ใช้งานจริงเอง รวมถึงอันเนื่องจากปัญหาความเข้ากันได้ ใด ๆ

7. โปรโมชั่นและส่วนลด

7.1 อาจมีการจัดทำคูปองส่วนลดเพื่อส่งเสริมการขายและรหัสส่วนลด ("ส่วนลด") แจกจ่ายให้กับผู้ใช้งานจริงบน พี2ดับเบิ้ลยูท็อปอัพ ซึ่งส่วนลดเหล่านี้มีผลใช้ได้บน พี2ดับเบิ้ลยูท็อปอัพ เท่านั้นและไม่สามารถโอนหรือแลกเปลี่ยนเป็น เงินสดได้

7.2 พี2ดับเบิ้ลยูท็อปอัพ ขอสงวนสิทธิ์ในการเปลี่ยนแปลงเงื่อนไขหรือยกเลิกโปรโมชั่นใดๆ โดยไม่ต้องแจ้งให้ทราบล่วงหน้า และอาจดำเนินการใดๆที่จำเป็น ซึ่งรวมถึงแต่ไม่จำกัดเพียง การถอนเงินอุดหนุนหรือเงินคืนแคชแบค การยกเลิกโปรโมชั่น การเพิกถอนโปรโมชั่น การยกเลิกธุรกรรม การอายัดเงิน การปิดบัญชี และอื่นๆ หากพบว่ามีการจัดการ ละเมิดหรือใช้ส่วนลดเพื่อประโยชน์ส่วนตัวของผู้ใช้งานจริง รวมถึงการบ่งชี้ถึงการฉ้อโกงหรือการละเมิดข้อกำหนดและเงื่อนไขของ พี2ดับเบิ้ลยูท็อปอัพ และบทบัญญัติทางกฎหมายที่ใช้ในประเทศไทย

7.3 อาจมีการระบุข้อกำหนดและเงื่อนไขเพิ่มเติมที่เกี่ยวข้องกับส่วนลดเฉพาะ (เช่น ระยะเวลา จำนวนส่วนลด วิธีการชำระเงิน และผลิตภัณฑ์ที่ครอบคลุม) และอาจมีการควบคุมการใช้งานและการแลกรับส่วนลดเหล่านั้นนอกเหนือไปจากข้อกำหนดเหล่านี้ได้

7.4 ในกรณีที่คำสั่งซื้อถูกยกเลิกหรือมีการขอคืนเงินหลังจากใช้ส่วนลดแล้ว ผู้ใช้งานจริงจะได้รับเงินคืนเฉพาะจำนวนเงินที่ชำระจริงเท่านั้น ซึ่งส่วนลดที่ใช้ไปแล้วจะไม่สามารถทำการขอคืนเงิน แลกคืน หรือแลกรับได้อีกต่อไป

7.5 บริษัทเราขอสงวนสิทธิ์ในการยกเลิกส่วนลดใด ๆ ที่มอบให้กับผู้ใช้งานจริงหรือคำสั่งซื้อที่ได้จัดทำเกี่ยวกับส่วนลดใด ๆ ที่ได้รับภายใต้หรือเป็นผลมาจากโปรแกรมส่งเสริมการขายตามดุลยพินิจแต่เพียงผู้เดียวและโดยไม่ต้องแจ้งให้ทราบล่วงหน้า รวมถึงในกรณีที่บริษัทเราพิจารณาด้วยดุลยพินิจแต่เพียงผู้เดียวว่าผู้ใช้งานจริงดังกล่าวได้ละเมิดข้อกำหนดใด ๆ รวมถึงแต่ไม่จำกัดเพียงเงื่อนไขการใช้งาน นโยบายความเป็นส่วนตัว และ/หรือข้อกำหนดและเงื่อนไขการขาย

7.6 เว้นแต่จะระบุไว้เป็นอย่างอื่น ส่วนลดต่าง ๆ จะไม่สามารถนำไปใช้ร่วมกับโปรโมชั่นหรือส่วนลดเชิงกลยุทธ์อื่นๆ ได้ ยกเว้นสินค้าที่ได้ส่วนลดล่วงหน้าใน พี2ดับเบิ้ลยูท็อปอัพ

8. ไฮเปอร์ลิงก์และการโฆษณา

8.1 เพื่อความสะดวกของท่าน บริษัทเราอาจใส่ไฮเปอร์ลิงก์บนเว็บไซต์อื่นหรือเนื้อหาบนอินเทอร์เน็ตที่เป็นของหรือซึ่งเป็นการดำเนินการโดยบุคคลที่สาม ซึ่งเว็บไซต์หรือเนื้อหาที่เชื่อมโยงดังกล่าวไม่อยู่ภายใต้การควบคุมของบริษัทเรา และบริษัทเราไม่ขอรับผิดชอบต่อข้อผิดพลาด การละเว้น ความล่าช้า การหมิ่นประมาท การใส่ร้าย การกล่าวหา การโกหก การอนาจาร ความลามก ความหยาบคาย ความไม่ถูกต้อง หรือสื่อที่น่ารังเกียจอื่นใดที่มีอยู่ในเนื้อหา หรือผลที่ตามมาจากการเข้าถึงเว็บไซต์ที่เชื่อมโยงใดๆ ซึ่งไฮเปอร์ลิงก์ไปเชื่อมไปยังเว็บไซต์หรือเนื้อหาอื่นๆ ไม่ถือเป็นการรับรองหรือยืนยันเว็บไซต์หรือเนื้อหาดังกล่าว และท่านยอมรับว่าการเข้าถึงหรือการใช้งานเว็บไซต์หรือเนื้อหาที่เชื่อมโยงดังกล่าวของท่านถือเป็นความเสี่ยงของท่านเองทั้งหมด

8.2 บริษัทเราอาจติดแบนเนอร์ จาวาแอพเพล็ต และ/หรือสื่ออื่นๆ ลงบนเว็บไซต์เพื่อวัตถุประสงค์ในการโฆษณาผลิตภัณฑ์ของเราหรือของผู้ขายได้ ทั้งนี้เพื่อความกระจ่างชัด ท่านจะไม่มีสิทธิ์ได้รับการชำระเงิน ค่าธรรมเนียม และ/หรือค่าคอมมิชชันใดๆ ในส่วนที่เกี่ยวกับการโฆษณาหรือสื่อส่งเสริมการขายอื่นๆ ดังกล่าวแต่อย่างใด

9. ข้อตกลงการให้บริการ

ขณะใช้ผลิตภัณฑ์ที่ซื้อจาก พี2ดับเบิ้ลยูท็อปอัพ หากผู้ใช้งานจริงประสบปัญหาใดๆ ผู้ใช้งานจริงจะต้องส่งคำถามและคำขอไปยังผู้จัดจำหน่ายโดยตรง ทั้งนี้ พี2ดับเบิ้ลยูท็อปอัพ ไม่ขอรับผิดชอบต่อการละเมิดข้อตกลงระดับบริการเฉพาะใดๆ ระหว่างผู้ใช้งานจริงและผู้ขายไม่ว่าในกรณีใด ๆ ทั้งสิ้น

10. การชำระเงิน

เพื่อให้มีช่องทางวิธีการชำระเงินที่หลากหลายมากยิ่งขึ้น พี2ดับเบิ้ลยูท็อปอัพ จึงร่วมมือกับผู้ให้บริการอื่นๆ เพื่อให้ผู้ใช้งานสามารถเลือกวิธีการชำระเงินที่เหมาะกับความต้องการของตนได้ง่ายยิ่งขึ้น โดยที่บริการชำระเงินและเรียกเก็บเงินจะเป็นการดำเนินการโดยผู้ให้บริการชำระเงินและเก็บเงินบุคคลที่สาม

11. การชำระภาษี

ค่าธรรมเนียมทั้งหมดยังไม่รวมภาษี ซึ่งบริษัทเราจะเรียกเก็บตามความเหมาะสม โดยที่ท่านมีหน้าที่ในการรับผิดชอบในการชำระภาษีของรัฐบาลที่เรียกเก็บจากการใช้ พี2ดับเบิ้ลยูท็อปอัพ ของท่าน รวมถึงแต่ไม่จำกัดเพียงภาษีการขาย ภาษีการใช้งาน หรือภาษีมูลค่าเพิ่ม และค่าธรรมเนียมอื่นๆ ที่คล้ายคลึงกันทั้งหมด (โดยเรียกรวมกันว่า "ภาษี")

12. การสงวนสิทธิ์การรับประกัน

ตามขอบเขตของกฎหมาย เว็บไซต์และบริการทั้งหมดที่ให้บริการโดย พี2ดับเบิ้ลยูท็อปอัพ เป็นการให้บริการแก่ท่าน "ตามที่เป็น" และ "ตามที่มี" โดยไม่มีการรับประกันหรือเงื่อนไขใดๆ ทั้งสิ้น ไม่ว่าโดยชัดแจ้งหรือโดยนัยก็ตาม รวมถึงแต่ไม่จำกัดอยู่เพียงการรับประกันโดยนัยและเงื่อนไขของการเป็นไปตามเงื่อนไขของการซื้อขายหรือการไม่ละเมิด

พี2ดับเบิ้ลยูท็อปอัพ ไม่ขอรับรอง สัญญา การรับประกัน หรือให้ความเข้าใจใดๆ ที่เกี่ยวข้องกับเว็บไซต์ บริการต่าง ๆรวมถึงบริการของบุคคลที่สาม หรือเนื้อหาภายใต้สัญญาฉบับนี้ ซึ่ง พี2ดับเบิ้ลยูท็อปอัพ จะไม่รับผิดต่อท่าน ลูกค้าของท่าน หรือบุคคลที่สามใดๆ ในกรณีที่มีการร้องเรียนหรือความรับผิดใดๆ ที่เกิดจากหรือเกี่ยวข้องกับการใช้ทรัพย์สินทางปัญญา บริการ รวมถึงบริการของบุคคลที่สาม เว็บไซต์ หรือจากการผลิต การใช้ การนำเข้า หรือการขายบริการ หรือสำหรับการร้องเรียนใดๆ ในการสูญเสียกำไร ความเสียหายหรือการหยุดชะงักของธุรกิจ หรือสำหรับความเสียหายในแบบทางอ้อม เป็นพิเศษ เป็นตัวอย่าง เป็นการลงโทษ หรือเป็นผลสืบเนื่องใดๆ

13. การชดเชยความเสียหาย

ท่านยินยอมในการชดเชยความเสียหายและยอมรับว่า พี2ดับเบิ้ลยูและบริษัทในเครือ เจ้าหน้าที่ ตัวแทน และพนักงาน ตัวแทนและซัพพลายเออร์บุคคลที่สาม ผู้ให้ใบอนุญาต และพันธมิตรใด ๆ ไม่มีส่วนรับผิดต่อการร้องเรียน การสูญเสีย ความเสียหาย ความรับผิดชอบ รวมถึงค่าธรรมเนียมและค่าใช้จ่ายทางกฎหมายที่เกิดขึ้นจากการใช้หรือใช้ในทางที่ผิดของ พี2ดับเบิ้ลยูท็อปอัพ หรือผลิตภัณฑ์ใดๆ การละเมิดข้อกำหนดเหล่านี้โดยท่าน หรือการละเมิดการรับรอง การรับประกัน และพันธสัญญาของท่าน

14. การจำกัดความรับผิด

14.1 พี2ดับเบิ้ลยูท็อปอัพ ไม่รับประกันว่า (๑) บริการของพี2ดับเบิ้ลยูท็อปอัพ จะตอบสนองความต้องการของผู้ใช้งานหรือสามารถเข้าถึงได้ตลอดเวลา (๒) บริการของพี2ดับเบิ้ลยูท็อปอัพ จะไม่ถูกรบกวน มีความตรงต่อเวลา ปลอดภัยและปราศจากข้อผิดพลาดใดๆ (๓) ผลลัพธ์ที่ได้จะแม่นยำหรือเชื่อถือได้เสมอ (๔) คุณภาพของผลิตภัณฑ์ บริการ ข้อมูลหรือสื่ออื่นใดที่ซื้อหรือได้รับผ่านบริการ พี2ดับเบิ้ลยูท็อปอัพ จะตรงตามความคาดหวังของผู้ใช้งานเสมอ

14.2 ผู้ใช้งานจริงมีหน้าที่รับผิดชอบและรับความเสี่ยงทั้งหมดต่อเนื้อหา ภาษา และแอปพลิเคชันที่ถูกส่งมาโดยเจตนาเพื่อให้พร้อมใช้งานและแสดงสำหรับบริการของพี2ดับเบิ้ลยูท็อปอัพ ทั้งนี้ในกรณีที่ผู้ใช้งานจริงละเมิดส่วนบุคคล เช่น แต่ไม่จำกัดเพียงการละเมิดทรัพย์สินทางปัญญา การจัดการระบบ การใช้บัญชีในทางที่ผิด หรือการประมาทเลินเล่อของผู้ใช้งานจริงรายอื่น ผู้ใช้งานจริงจึงต้องรับผิดชอบส่วนบุคคลสำหรับการละเมิดดังกล่าวและปกป้องมิให้ ของพี2ดับเบิ้ลยูท็อปอัพ เข้ามีส่วนรับผิดในการเรียกร้องค่าเสียหายจากบุคคลที่สาม

14.3 เพื่อให้มีวิธีการชำระเงินที่หลากหลายมากยิ่งขึ้น พี2ดับเบิ้ลยูท็อปอัพ จึงร่วมมือกับฝ่ายอื่นๆ เพื่อให้ผู้ใช้งานจริงสามารถเลือกวิธีการชำระเงินที่เหมาะกับความต้องการของตนได้ง่ายขึ้น ดังนั้น ในกรณีที่วิธีการชำระเงินที่พันธมิตรด้านการชำระเงินได้จัดเตรียมไว้มีความคลาดเคลื่อนและ/หรือผิดพลาด ทั้งในระบบและการใช้งาน ผู้ใช้งานจริงสามารถยื่นคำร้องต่อพันธมิตรด้านการชำระเงินได้โดยตรง และด้วยเหตุนี้ พี2ดับเบิ้ลยูท็อปอัพ จึงไม่ต้องรับผิดชอบในการชดเชยความเสียหายที่เกิดจากข้อผิดพลาดของพันธมิตรด้านการชำระเงิน

15. ระยะเวลาและการสิ้นสุดสัญญา

ก) ผลของการยุติการให้บริการ: เมื่อบริการหมดอายุหรือมีการยุติการให้บริการด้วยเหตุผลใดก็ตามตามที่ได้รับการอนุญาตในข้อกำหนดและเงื่อนไขแห่งสัญญาฉบับนี้ ท่านต้องหยุดใช้และ พี2ดับเบิ้ลยูท็อปอัพ จะหยุดให้บริการดังกล่าว ในกรณีที่มีการยุติการให้บริการดังกล่าว พี2ดับเบิ้ลยูท็อปอัพ จะไม่คืนเงินค่าธรรมเนียมที่ได้มีการชำระล่วงหน้าสำหรับผลิตภัณฑ์ที่ได้สั่งซื้อไปแล้ว และท่านมีหน้าที่รับผิดชอบในการชำระเงิน ซึ่งพี2ดับเบิ้ลยูท็อปอัพ สามารถยุติการให้บริการนี้และการสมัครรับบริการใดๆ ก็ตามเมื่อใดก็ตามด้วยเหตุผลใดๆ ก็ตาม หรือไม่มีเหตุผลใดๆ โดยไม่ต้องแจ้งให้ท่านทราบล่วงหน้าได้

ข) การคงอยู่ของข้อบังคับ: เมื่อสิ้นสุดการให้บริการไม่ว่าด้วยเหตุผลใดก็ตาม ท่านตกลงว่าท่านจะชำระเงินทั้งหมดที่ค้างชำระให้กับ พี2ดับเบิ้ลยูท็อปอัพ ในทันที ซึ่งข้อกำหนดใดๆ ที่จำเป็นในการตีความหรือจำเป็นสำหรับการบังคับใช้สิทธิและภาระผูกพันจะยังคงมีผลบังคับใช้ต่อไปแม้ว่าจะยุติการให้บริการแล้วก็ตาม รวมถึงแต่ไม่จำกัดเพียง ข้อกำหนดการชำระเงิน ข้อกำหนดการชดเชย ข้อจำกัดความรับผิด และเงื่อนไขการคงอยู่และข้อ 17 (ระยะเวลาและการยุติการให้บริการ) นี้

16. การบังคับใช้

ในกรณีที่มีบทบัญญัติใด ๆ ในข้อกำหนดและเงื่อนไขเหล่านี้ไม่สามารถนำไปบังคับใช้หรือไม่ถูกต้องตามกฎหมายที่บังคับใช้อยู่ได้ การไม่สามารถบังคับใช้หรือไม่ถูกต้องดังกล่าวจะไม่ส่งผลให้ข้อกำหนดและเงื่อนไข ต่าง ๆ เหล่านี้ไม่สามารถบังคับนำไปใช้หรือตกเป็นความไม่ถูกต้องโดยรวมได้ ซึ่งพี2ดับเบิ้ลยูท็อปอัพ จะดำเนินการแก้ไขหรือแทนที่บทบัญญัติดังกล่าวด้วยบทบัญญัติที่ถูกต้องและบังคับใช้ได้ และบรรลุวัตถุประสงค์และเจตนาเดิมของบริษัทเราเท่าที่ทำได้ตามที่สะท้อนอยู่ในบทบัญญัติเดิม

17. การรวบรวมข้อมูลส่วนบุคคล

ผู้ใช้งานจริงยินยอมให้ พี2ดับเบิ้ลยูท็อปอัพ รวบรวมข้อมูลส่วนบุคคลตามภาคผนวก ก: เงื่อนไขการรวบรวม การใช้ และการเปิดเผยข้อมูลส่วนบุคคล

ภาคผนวก ก: ข้อกำหนดในการรวบรวม การใช้ และการเปิดเผยข้อมูลส่วนบุคคล

ผู้ใช้งานจริงตกลงและยอมรับการรวบรวม การใช้ และการเปิดเผยข้อมูลส่วนบุคคลซึ่ง พี2ดับเบิ้ลยูจะทำการรวบรวม จัดเก็บ และใช้ข้อมูลส่วนบุคคลของผู้ใช้งานจริงเพื่อวัตถุประสงค์ในการให้บริการที่ผู้ใช้งานจริงเข้าถึงและเป็นไปตามกฎหมายดังต่อไปนี้

1. "ข้อมูลส่วนบุคคล" หมายถึง ชื่อ-นามสกุล ที่อยู่ ข้อมูลทางการเงิน ข้อมูลการทำธุรกรรม ข้อมูลสุขภาพ ข้อมูลทางชีวภาพ (เช่น ลายนิ้วมือ การจดจำใบหน้า เป็นต้น) ความพิการ และ/หรือข้อมูลอื่นใดของผู้ใช้งานจริงซึ่งเหมาะสมต่อการให้บริการ ซึ่งเกี่ยวข้องกับข้อมูลระบุตัวตนของผู้ใช้งานจริงไม่ว่าจะสามารถระบุได้โดยตรงหรือโดยอ้อม ซึ่งผู้ใช้งานจริงได้ให้ข้อมูลไว้กับ พี2ดับเบิ้ลยูหรือ พี2ดับเบิ้ลยูได้รับหรือเข้าถึงจาก แหล่งอื่น

2. พี2ดับเบิ้ลยูต้องดำเนินรวบรวม จัดเก็บ นำข้อมูลส่วนบุคคลของผู้ใช้งานจริงไปใช้เพื่อจุดประสงค์หรือกิจกรรมที่ผู้ใช้งานจริงอาจสนใจในด้านที่เกี่ยวข้องกับบริการโทรคมนาคม บริการออกอากาศ บริการชำระเงินหรือบริการอื่น บริการดิจิทัล การวิจัยและสำรวจการตลาด กิจกรรมส่งเสริมการขาย การให้สิทธิพิเศษตามความชอบของผู้ใช้งานจริงหรือการวิเคราะห์ข้อมูลเพื่อเสนอสินค้าหรือบริการของ พี2ดับเบิ้ลยูและ/หรือบุคคลที่เป็นผู้จัดจำหน่าย ตัวแทนหรือผู้ที่เกี่ยวข้องกับ และ/หรือบุคคลอื่น หรือภาระผูกพันทางกฎหมายหรือระเบียบข้อบังคับที่ควบคุม พี2ดับเบิ้ลยูอยู่ ไม่ว่าในปัจจุบันหรือในอนาคต รวมถึงการอนุญาตให้ พี2ดับเบิ้ลยู ส่ง โอน และ/หรือเปิดเผยข้อมูลส่วนบุคคลแก่ผู้รับซึ่งเป็นบริษัทในกลุ่มธุรกิจของ พี2ดับเบิ้ลยู พันธมิตรทางธุรกิจ องค์กร หรือนิติบุคคลที่มีสัญญาหรือมีความสัมพันธ์ทางกฎหมายกับ พี2ดับเบิ้ลยู โดยให้ พี2ดับเบิ้ลยู ส่ง โอน และ/หรือเปิดเผยข้อมูลดังกล่าวผ่านในประเทศและต่างประเทศ ซึ่งพี2ดับเบิ้ลยูจะดำเนินการเก็บรักษาข้อมูลส่วนบุคคลของผู้ใช้งานจริงในกรณีที่จำเป็นและเพื่อวัตถุประสงค์ที่กล่าวข้างต้นเท่านั้น โดยผู้รับข้อมูลมีหน้าที่ในการเก็บรักษาข้อมูลส่วนบุคคลตามกฎหมายด้วยเช่นกัน ทั้งนี้หากมีการปรับปรุงวัตถุประสงค์ในการรวบรวมข้อมูลส่วนบุคคลในภายหลังนั้น พี2ดับเบิ้ลยูจะดำเนินการแจ้งให้ผู้ใช้งานจริงทราบ

3. ผู้ใช้งานจริงมีสิทธิ์ในการถอนข้อมูลส่วนบุคคลของผู้ใช้งานจริงได้ตลอดเวลา เว้นแต่การถอดถอนดังกล่าวจะมีผลต่อบริการหรืออยู่นอกเหนือการควบคุมของ พี2ดับเบิ้ลยู

4. ข้อกำหนดในการรวบรวม การใช้ และการเปิดเผยข้อมูลส่วนบุคคลจะมีผลบังคับใช้ในระยะเวลาตามที่กฎหมายกำหนด

5. สิทธิของผู้ใช้งานจริงในการเพิกถอน เข้าถึง หรือขอสำเนาข้อมูลส่วนบุคคล การคัดค้านการรวบรวม การใช้ หรือการเปิดเผย สิทธิในการพกพาข้อมูล สิทธิในการลบ สิทธิในการระงับการใช้งานข้อมูลส่วนบุคคลจะต้องสอดคล้องกับนโยบายความเป็นส่วนตัวของเรา และของบุคคลอื่นๆ ตามที่กฎหมายกำหนด

e) deactivate, cancel, delete, ban, prevent and restrict any access to the Site and/or the Service of and by any P2W TOPUP account, the End User and/or anyone whether permanently or temporarily and without giving any reason or prior notice.

3. Privacy Policy

3.1 Your use of the Services and/or access to the P2W TOPUP is also subject to the Privacy Policy as set out at https://p2wtopup.com/policy

4. P2W TOPUP User Account

4.1 End User hereby declares that the End User is a capable person and is capable of binding himself in a legal agreement.

4.2 P2W TOPUP does not charge End User for registering to P2W TOPUP Service.

4.3 You must create your user account with an active Thai mobile number or email address and complete all verification prior to completing any Order on P2W TOPUP.

4.4 You agree that P2W may disclose and share your information on P2W TOPUP to relevant third-party as part of providing the Service to you.

5. Terms for Sale of Products

5.1 You acknowledge that P2W neither directly sell nor own any Product on the Site, and is only facilitating the Sale of Products by the Seller to the End User. The name of the Seller of the Product is publicly displayed on the Site.

5.2 Your authorization to use any Products is provided by the Seller and not P2W, and is subject to any terms and conditions of services as made available by the Seller, including, but not limited to, warranties (if any), ownership of intellectual property and permitted uses. Each agreement entered into for the Sale of Products to an End User shall be an agreement entered into directly and only between the Seller and the End User and also subjected to the Terms and Conditions of Sale listed here.

5.3 You acknowledge and agree that You must contact the respective Seller or its designated representative with regards to any service issues, including any issues with support. P2W provides customer support to You at no additional fee for service issues related to the use of the P2W TOPUP.

5.4 Product Description:

a) While we endeavor to provide an accurate description of the Products on Product Detail Page, we do not warrant that such description is accurate, current or free from error.

5.5 Prices of Products:

a) All Product Prices are subject to taxes, unless explicitly stated otherwise.

b) We, as notified and requested by the Seller, reserve the right to amend the Prices at any time without giving any reason or prior notice.

5.6 Order Placement:

a) You may place an Order by completing the Order form on the Site and clicking on the confirm button. The Seller will not accept Orders placed in any other manner. You shall be responsible for ensuring the accuracy of the Order.

b) Orders are irrevocable and unconditional upon transmission of payment confirmation. Orders cannot be returned, refunded, transferred and/or canceled.

c) P2W TOPUP will provide a bill summary of your accrued fees to You and You shall make payment according to terms and conditions in clause 12. In this regard, you acknowledge and agree that the Products shall be delivered to you upon completion of payment.

d) The Price of Products shown in the Site will be in local currency.

e) If You fail to make timely payment, You agree that P2W may, in addition to all other rights and remedies provided to P2W TOPUP hereunder or at law, terminate or suspend the affected Products.

6. Refunds

All transactions made in accordance with these Terms and Conditions are final. Products distributed through P2W TOPUP shall have a strict no-refund policy. Please be sure the Products are right for you before purchasing. End Users are solely responsible for confirming that their devices are compatible with the Products they purchase. All virtual item purchases are final, non-refundable and non-returnable. We do not offer refunds or exchanges for the incorrect purchase of Products caused by End Users' own conduct, including due to compatibility issues.

7. Promotion and Discounts

7.1 There may be promotional discount coupons and discount codes ("Discounts") distributed to the End User on P2W TOPUP. These Discounts are valid only on the P2W TOPUP and cannot be transferable or exchangeable for cash.

7.2 P2W TOPUP reserves the right, without prior notice, to change these terms or cancel any promotions at any time and to take necessary actions including but not limited to withdrawing subsidies or cashback, canceling promotion, revoking promotion, canceling transactions, holding funds, closing accounts, and other things if there is found manipulation, violation or utilization of the Discounts for the personal benefit of the End User, as well as an indication of fraud or violation to P2W TOPUP Terms and Conditions and legal provisions that apply in Thailand.

7.3 Additional terms and conditions may be specified in relation to specific Discounts (for example, duration, discount amount, payment method and products covered), and will govern the use and redemption of those Discounts in addition to these terms.

7.4 In the event where the Order is canceled or refunded after the Discounts have been redeemed, the End User will receive a refund only of the amount actually paid. Discounts used cannot be refunded, returned or redeemed anymore.

7.5 We reserve the right to cancel any Discounts awarded to an End User or Orders placed in connection with any Discounts that were obtained under or as a result of the promotional program at its sole discretion and without prior notice including the case that where we determine in its sole and absolute discretion that such End User has breached any terms including but not limited to the Terms of Use, Privacy Policy and/or the Terms & Conditions of Sale.

7.6 Unless otherwise stated, Discounts are not valid in conjunction with other tactical promotions or discounts, with the exception of pre-discounted products on P2W TOPUP.

8. Hyperlinks and Advertising

8.1 For your convenience, we may include hyperlinks to other websites or content on the Internet that are owned or operated by third parties. Such linked websites or content are not under our control and we are not liable for any errors, omissions, delays, defamation, libel, slander, falsehood, obscenity, pornography, profanity, inaccuracy or any other objectionable material contained in the contents, or the consequences of accessing, any linked website. Any hyperlinks to any other websites or content are not an endorsement or verification of such websites or content and you agree that your access to or use of such linked websites or content is entirely at your own risk.

8.2 We may attach banners, java applets and/or such other materials to the Site for the purposes of advertising our or our Seller's Products. For the avoidance of doubt, you shall not be entitled to receive any payment, fee and/or commission in respect of any such advertising or other promotional materials.

9. Service Level Agreement

While using Products bought from P2W TOPUP, if the End User faces any difficulties, the End User shall raise the questions and request directly to the Seller. Under no circumstances P2W TOPUP will be responsible for violation of any specific service level agreement between the End User and the Seller.

10. Payment

In order to provide a more varied payment method, P2W TOPUP collaborates with other parties to make it easier for users to choose the payment method that suits their needs. The payment and collection service is performed by third-party payment and collection service provider(s).

11. Taxes

All fees are exclusive of taxes, which we will charge as applicable. You are responsible for paying any governmental taxes imposed on Your use of P2W TOPUP, including, but not limited to, sales, use or value-added taxes, and all other similar charges (collectively, "Taxes").

12. Warranty Disclaimer

To the extent permitted by law, the Site and all services provided by P2W TOPUP are provided to you "as is" and "as available" without warranty or condition of any kind, either express or implied, including, but not limited to, the implied warranties and conditions of merchantability, or non-infringement.

P2W TOPUP makes no other representations, promises, warranties or understandings of any kind relating to the Site, services, including third party services, or content under this agreement. P2W TOPUP shall not be liable to you, your customers or any third party for any claim or liability arising from or relating to your use of the intellectual property, the services, including third party services, the Site, or from the manufacture, use, importation or sale of the services, or for any claim for loss of profits, loss or interruption of business, or for indirect, special, exemplary, punitive, or consequential damages of any kind.

13. Indemnity

You agree to indemnify and hold P2W and its affiliates, officers, agents, and employees, agents and its third party suppliers, licensors and partners harmless from any claims, losses, damages, liabilities, including legal fees and expenses, rising out of Your use or misuse of the P2W TOPUP or any Products, Your violation of these Terms, or any breach of your representations, warranties, and covenants.

14. Limitation of Liability

14.1 P2W TOPUP does not guarantee that (i) P2W TOPUP Services will always meet user needs or will always be accessible; (ii) P2W TOPUP Services will not be disturbed, timely, safe and free from any errors; (iii) The results obtained will always be accurate or reliable; (iv) the quality of each product, service, information or other material purchased or obtained through P2W TOPUP Services will always meet user expectations.

14.2 End User is responsible for and bears all risks to the content, language and applications that are consciously submitted so that they are available and displayed for P2W TOPUP Services. In the event of a personal violation by an End Users such as but not limited to IPR infringement, system manipulation, account misuse or other End User's negligence, End User is personally responsible for the violation and shall exclude P2W TOPUP from claims arising from third parties.

14.3 In order to provide a more varied payment method, P2W TOPUP collaborates with other parties to make it easier for End Users to choose the payment method that suits their needs. Therefore in the event that there is a discrepancy and/or error in the payment method provided by the payment partner, both in the system and its usage, the End Users can directly file a complaint with the payment partner and hereby release the P2W TOPUP from the responsibility to provide compensation for losses incurred due to the error of the payment partner.

15. Term and Termination

a) Effect of termination of Service: Upon expiration or other termination of the Service(s) for any reason as permitted in this Terms and Conditions, You must stop using, and P2W TOPUP will stop providing, the terminated Service(s). In the event of such termination, P2W TOPUP will not refund any prepaid fees for Products purchased and You will be responsible for payment. P2W TOPUP may terminate this Service and any Service subscription at any time for any reason, or no reason, without providing any advance notice to You.

b) Survival: Upon termination of Service(s) for any reason, You agree that You will immediately pay all amounts owed to P2W TOPUP. Any provision required by its construction or required for rights and obligations enforcement, shall survive termination, including, but not limited to, the payment provision, the indemnity provisions, limitations of liability and the survival terms and this Section 17 (Term and Termination).

16. Enforceability

In the event that any provision of these Terms and Conditions are unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render this Terms and Conditions unenforceable or invalid as a whole. P2W will amend or replace such provision with one that is valid and enforceable, and which achieves, to the extent possible, our original objectives and intent as reflected in the original provision.

17. Personal Data Collection

End User hereby provides consent to P2W TOPUP for the collection of personal subject to the Attachment A: Terms for Collect, Use and Disclose of Personal Data.

End User hereby agrees and accepts to the collection, usage and disclosure of Personal Data in which P2W shall collect, store, use of End User's Personal Data for the purpose of Service in which the End User has accessed and in accordance with the law as follows:

1. "Personal Data" means End User's full name, address, financial information, transaction information, health information, biological information (e.g. fingerprint, face recognition and etc.) disabilities and/or other information, which is appropriate for providing service, related to the identifiable of End User whether can be identified directly or indirectly in which End User has provided to P2W or P2W has received or accessed from other sources.

2. P2W shall collect, store, use of End User's Personal Data for the purpose or activity which End User may be interested in relating to telecommunication service, broadcasting service, payment service or other services, digital service, marketing research and survey, promotional activities, providing privilege based on End User's preferences or data analysis in order to offer goods or services of P2W and/or a person who is a distributor, agent, or the person who related thereof, and/or other person, or legal obligations or regulation to which P2W is subject whether present or in the future, including permission P2W to send, transfer and/or disclose personal data to the recipient that is a company within P2W's business group, business alliance, organization or juristic person who has a contract or a legal relationship with P2W by allowing P2W to send, transfer and/or disclose such information through domestically and internationally. P2W shall retain End Users' Personal Data, if necessary and only for the above-mentioned purposes, where the recipient is also obligated by law to retain Personal Data as well. If there is a later update in the purpose of collecting Personal Data, P2W will inform the End User.

3. The End User has the right to withdraw End Users' Personal Data at any time, unless such withdrawal affects the Services or is beyond P2W's control.

4. Terms for the collection, usage and disclosure of Personal Data shall be effective for a period specified by law.

5. End User's right to withdraw, access or request for copy of Personal Data, objection to the collection, usage or disclosure, rights to data portability, rights to erasure, rights to suspend the use of Personal Data shall be in accordance with our privacy policy, and others as specified by law.
