ข้อกำหนดและเงื่อนไขของ P2W TOPUP

1. คำนิยาม

บริษัท เปย์ ทู วิน จำกัด (ซึ่งบางครั้งอาจจะถูกเรียกว่า "P2W" หรือ "P2W TOPUP") เป็นบริษัทที่ดำเนินธุรกิจให้บริการ P2W TOPUP ผ่านเว็บไซต์ www.p2wtopup.com ซึ่งเป็นเว็บไซต์ที่ให้บริการเกี่ยวกับความต้องการต่าง ๆ ของผู้ใช้ที่เกี่ยวข้องกับเกม

ข้อกำหนดและเงื่อนไขหมายถึงข้อตกลงระหว่างผู้ใช้บริการ (End Users) และ P2W TOPUP ซึ่งประกอบด้วยชุดกฎระเบียบที่กำหนดสิทธิ หน้าที่ ความรับผิดชอบของผู้ใช้บริการและ P2W TOPUP รวมทั้งขั้นตอนในการใช้บริการ P2W TOPUP (ซึ่งบางครั้งอาจจะเรียกว่า "บริการ")

คำว่า เรา หรือ พวกเราหมายถึง P2W TOPUP

คำว่า "ท่าน" หรือ "ของท่าน" ในข้อตกลงนี้หมายถึงบุคคลหรือหน่วยงานใด ๆ ที่ยอมรับข้อตกลงนี้, เข้าถึงบัญชีของท่าน, ใช้บริการหรือเว็บไซต์, หรือสั่งซื้อบริการ ซึ่งท่านอาจจะถูกเรียกแทนว่า "ผู้ใช้บริการ" ตามข้อกำหนดและเงื่อนไขนี้

"ผู้ใช้บริการ" หรือ "ลูกค้า" หมายถึงผู้ใช้บริการที่ซื้อผลิตภัณฑ์จากผู้ขายผ่าน P2W TOPUP

"คำสั่งซื้อ" หมายถึงคำสั่งซื้อผลิตภัณฑ์จากท่าน

"บริการ" หรือ "บริการ P2W TOPUP" หมายถึงบริการที่ P2W TOPUP ให้เพื่อช่วยอำนวยความสะดวกแก่ผู้ใช้บริการในการช้อปปิ้ง, ชำระเงิน และรับผลิตภัณฑ์จากผู้ขาย

"เว็บไซต์" หมายถึงเว็บไซต์ P2W TOPUP ที่สามารถเข้าถึงได้ที่ https://www.p2wtopup.com

"ผู้ขาย" หมายถึงเจ้าของผลิตภัณฑ์ที่จัดจำหน่ายผ่าน P2W TOPUP ซึ่งผู้ใช้บริการสามารถซื้อและทำธุรกรรมโดยตรงกับผู้ขาย

"ผลิตภัณฑ์" หมายถึงผลิตภัณฑ์และบริการบนเว็บไซต์ที่ P2W TOPUP เป็นเพียงผู้ช่วยในการขายผลิตภัณฑ์ เช่น การเติมเกมและผลิตภัณฑ์อื่น ๆ ที่เกี่ยวข้อง โดยผู้ขายขายให้กับผู้ใช้บริการ นอกจากนี้ยังมีผลิตภัณฑ์บางอย่างที่ P2W TOPUP จัดหามาเอง เช่น แพ็กเกจข้อมูลเกม, การสมัครสมาชิกเกม, และรหัสไอเท็มเกม

2. การใช้บริการทั่วไป

ท่านตกลงที่จะปฏิบัติตามแนวทาง, ข้อความแจ้ง, กฎการดำเนินงาน, นโยบาย และคำแนะนำที่เกี่ยวข้องกับการใช้บริการและ/หรือการเข้าถึงเว็บไซต์ รวมทั้งการแก้ไขใด ๆ ที่ได้กำหนดขึ้นโดยเราเป็นระยะ ๆ เราขอสงวนสิทธิ์ในการแก้ไขแนวทาง, ข้อความแจ้ง, กฎการดำเนินงาน, นโยบาย และคำแนะนำเหล่านี้ได้ตลอดเวลา และท่านจะถือว่าทราบและยอมรับการเปลี่ยนแปลงใด ๆ ที่เกิดขึ้นจากการเผยแพร่ในเว็บไซต์

2.1 ท่านตกลงและยอมรับที่จะไม่:

ก) ใช้บริการ P2W TOPUP ในทางใดทางหนึ่งที่ละเมิดกฎหมายที่เกี่ยวข้องหรือเพื่อวัตถุประสงค์ที่ผิดกฎหมาย

ข) พยายามทำลาย, รบกวน, หรือมีส่วนร่วมในกิจกรรมใด ๆ ที่ทำให้ P2W TOPUP, เว็บไซต์ของเรา, หรือบริการของเราลดลง

ค) ก่อกวนการใช้บริการ P2W TOPUP ของผู้อื่น

ง) แสดงตนหรือปลอมแปลงตัวตนเป็นบุคคลหรือหน่วยงานใด ๆ รวมถึงแต่ไม่จำกัดเพียงผู้ใช้บริการของเว็บไซต์นี้, กรรมการ, เจ้าหน้าที่, พนักงาน, ผู้ถือหุ้น, ตัวแทน หรือผู้แทนของ P2W TOPUP, บริษัทในเครือของเรา หรือบุคคลหรือหน่วยงานอื่น ๆ หรือแถลงข้อมูลเท็จหรือแสดงการเชื่อมโยงของท่านกับ P2W TOPUP, บริษัทในเครือของเรา หรือบุคคลหรือหน่วยงานอื่น ๆ หรือควบคุมสิทธิ์ในวัสดุเหล่านั้นหรือได้รับการยินยอมที่จำเป็นทั้งหมด

จ) ใช้บริการ P2W TOPUP เพื่อเก็บเกี่ยวหรือรวบรวมข้อมูลเกี่ยวกับผู้อื่น รวมถึงที่อยู่อีเมล

ฉ) พยายามปรับเปลี่ยน, แปล, ปรับปรุง, แก้ไข, คัดลอก, ถอดรหัส, แยกชิ้นส่วน หรือย้อนกลับซอฟต์แวร์ใด ๆ ที่ใช้หรือจัดหามาโดย P2W TOPUP

ช) วิศวกรรมซอฟต์แวร์ที่ใช้หรือให้บริการโดย P2W TOPUP

ซ) ใช้หรือพยายามเข้าถึงบัญชี, คอมพิวเตอร์ หรือเครือข่ายที่เกี่ยวข้องกับ P2W TOPUP โดยไม่ได้รับอนุญาต

ฌ) พยายามได้รับข้อมูลใด ๆ ผ่านทางใด ๆ จาก P2W TOPUP ยกเว้นกรณีที่เรามีเจตนาจะให้หรือทำให้ข้อมูลนั้นพร้อมใช้งานสำหรับท่าน

ญ) พยายามคิดค่าบริการจากผู้อื่นในการใช้บริการ P2W TOPUP ทั้งทางตรงหรือทางอ้อม

ฎ) ใช้บริการ P2W TOPUP เพื่อการใส่ร้าย, ล่วงละเมิด, รังควาน, ติดตาม, ข่มขู่ หรือกระทำการใด ๆ ที่ละเมิดสิทธิทางกฎหมายของผู้อื่น

ฏ) กระทำในลักษณะที่มีผลกระทบในทางลบหรือทำให้ประสบการณ์ของผู้ใช้บริการอื่นบนเว็บไซต์นี้ลดลง

2.2 เราอาจปรับปรุง แก้ไข ระงับ หรือยุติการให้บริการ หรือเอาเว็บไซต์หรือบริการใด ๆ ออกทั้งหมดหรือบางส่วนเป็นครั้งคราว โดยไม่จำเป็นต้องระบุเหตุผลหรือแจ้งล่วงหน้า และจะไม่ต้องรับผิดหากการปรับปรุง แก้ไข ระงับ หรือการเอาออกดังกล่าว ทำให้ท่านไม่สามารถเข้าถึงเว็บไซต์หรือบริการบางส่วนหรือทั้งหมดได้

2.3 ท่านตกลงว่าจะไม่แก้ไข ดัดแปลง ทำซ้ำ คัดลอก จำหน่าย ทำซ้ำเพื่อจำหน่าย หรือใช้ประโยชน์จากส่วนหนึ่งส่วนใดของบริการ การใช้บริการ หรือการเข้าถึงบริการ โดยไม่ได้รับอนุญาตเป็นลายลักษณ์อักษรจาก P2W TOPUP

2.4 เราขอสงวนสิทธิ์ในการ:

ก) ตรวจสอบ, คัดกรอง หรือควบคุมกิจกรรม, เนื้อหา หรือวัสดุใด ๆ บนเว็บไซต์และ/หรือผ่านบริการของเรา เราอาจสืบสวนการละเมิดข้อกำหนดและเงื่อนไขที่ระบุไว้ในที่นี้ และอาจดำเนินการใด ๆ ที่เราเห็นว่าเหมาะสม ตามดุลยพินิจของเราแต่เพียงผู้เดียว

ข) ป้องกันหรือจำกัดการเข้าถึงเว็บไซต์และ/หรือบริการของเราโดยผู้ใช้บริการ

ค) รายงานกิจกรรมใด ๆ ที่เราสงสัยว่าจะละเมิดกฎหมาย, ระเบียบข้อบังคับ หรือข้อบังคับที่เกี่ยวข้องให้แก่หน่วยงานที่เหมาะสมและร่วมมือกับหน่วยงานเหล่านั้น

ง) ขอข้อมูลและข้อมูลจากท่านที่เกี่ยวข้องกับการใช้บริการและ/หรือการเข้าถึงเว็บไซต์ของท่านได้ทุกเมื่อ และใช้สิทธิของเราในตามข้อกำหนดนี้หากท่านปฏิเสธที่จะเปิดเผยข้อมูลและ/หรือข้อมูลดังกล่าว หรือหากท่านให้ข้อมูลและ/หรือข้อมูลที่เราอาจสงสัยว่าไม่ถูกต้อง, ชี้นำผิด, หรือเป็นข้อมูลเท็จและ/หรือหลอกลวง

จ) ปิดการใช้งาน, ยกเลิก, ลบ, แบน, ป้องกัน และจำกัดการเข้าถึงเว็บไซต์และ/หรือบริการจากบัญชี P2W TOPUP ของผู้ใช้บริการ และ/หรือบุคคลใด ๆ ไม่ว่าจะเป็นการปิดถาวรหรือชั่วคราวโดยไม่จำเป็นต้องระบุเหตุผลหรือแจ้งล่วงหน้า

3. นโยบายความเป็นส่วนตัว

3.1 การใช้บริการและ/หรือการเข้าถึง P2W TOPUP ของท่านต้องปฏิบัติตามนโยบายความเป็นส่วนตัวที่ระบุไว้ที่ https://p2wtopup.com/policy

4. บัญชีผู้ใช้ P2W TOPUP

4.1 ผู้ใช้ปลายทางขอประกาศว่า ผู้ใช้ปลายทางเป็นบุคคลที่มีความสามารถและสามารถผูกพันตนเองในข้อตกลงทางกฎหมายได้

4.2 P2W TOPUP ไม่คิดค่าธรรมเนียมในการลงทะเบียนบริการ P2W TOPUP จากผู้ใช้ปลายทาง

4.3 ท่านต้องสร้างบัญชีผู้ใช้ด้วยหมายเลขโทรศัพท์มือถือไทยที่ใช้งานได้หรือที่อยู่อีเมลและทำการยืนยันข้อมูลทั้งหมดก่อนที่จะดำเนินการคำสั่งซื้อใด ๆ บน P2W TOPUP

4.4 ท่านตกลงว่า P2W อาจเปิดเผยและแชร์ข้อมูลของท่านบน P2W TOPUP กับบุคคลที่สามที่เกี่ยวข้องเป็นส่วนหนึ่งของการให้บริการแก่ท่าน

5. ข้อกำหนดสำหรับการขายสินค้า

5.1 ท่านยอมรับว่า P2W ไม่ได้ขายสินค้าโดยตรงหรือเป็นเจ้าของสินค้าบนเว็บไซต์ และทำหน้าที่เพียงอำนวยความสะดวกในการขายสินค้าจากผู้ขายไปยังผู้ใช้ปลายทาง ชื่อของผู้ขายสินค้าจะแสดงให้เห็นอย่างชัดเจนบนเว็บไซต์

5.2 การอนุญาตให้ท่านใช้สินค้าจะได้รับจากผู้ขายและไม่ใช่จาก P2W และอยู่ภายใต้ข้อกำหนดและเงื่อนไขของบริการที่ผู้ขายจัดให้ รวมถึงแต่ไม่จำกัดเพียง การรับประกัน (หากมี) การเป็นเจ้าของทรัพย์สินทางปัญญาและการใช้งานที่อนุญาต ข้อตกลงแต่ละข้อที่ทำขึ้นสำหรับการขายสินค้าให้กับผู้ใช้ปลายทางจะเป็นข้อตกลงที่ทำโดยตรงและเฉพาะระหว่างผู้ขายและผู้ใช้ปลายทาง และต้องปฏิบัติตามข้อกำหนดและเงื่อนไขของการขายที่ระบุไว้ที่นี่

5.3 ท่านยอมรับและตกลงว่า ท่านต้องติดต่อผู้ขายหรือผู้แทนที่ได้รับมอบหมายของผู้ขายเกี่ยวกับปัญหาการบริการ รวมถึงปัญหาใด ๆ ที่เกี่ยวข้องกับการสนับสนุน P2W ให้การสนับสนุนลูกค้าแก่ท่านโดยไม่คิดค่าธรรมเนียมเพิ่มเติมสำหรับปัญหาการบริการที่เกี่ยวข้องกับการใช้บริการ P2W TOPUP

5.4 คำอธิบายสินค้า

ก) แม้ว่าเราจะพยายามให้คำอธิบายที่ถูกต้องของสินค้าในหน้ารายละเอียดสินค้า แต่เราไม่รับประกันว่าคำอธิบายนั้นถูกต้อง อัปเดต หรือปราศจากข้อผิดพลาด

5.5 ราคาสินค้า:

ก) ราคาสินค้าทั้งหมดอยู่ภายใต้ภาษี เว้นแต่จะมีการระบุไว้เป็นอย่างอื่น

ข) เรา ซึ่งได้รับการแจ้งและขอจากผู้ขาย ขอสงวนสิทธิ์ในการปรับเปลี่ยนราคาตามที่เห็นสมควรโดยไม่ต้องให้เหตุผลหรือแจ้งล่วงหน้า

5.6 การสั่งซื้อ:

ก) ท่านสามารถทำการสั่งซื้อโดยการกรอกแบบฟอร์มสั่งซื้อบนเว็บไซต์และคลิกปุ่มยืนยัน ผู้ขายจะไม่รับคำสั่งซื้อที่ทำในรูปแบบอื่น ท่านต้องรับผิดชอบในการตรวจสอบความถูกต้องของคำสั่งซื้อ

ข) คำสั่งซื้อเป็นคำสั่งที่ไม่สามารถยกเลิกได้และไม่มีเงื่อนไขเมื่อการยืนยันการชำระเงินถูกส่งแล้ว คำสั่งซื้อไม่สามารถคืนเงิน, ขอคืนสินค้า, โอนสิทธิ์ และ/หรือ ยกเลิกได้

ค) P2W TOPUP จะจัดเตรียมสรุปใบแจ้งหนี้เกี่ยวกับค่าธรรมเนียมที่ท่านค้างชำระให้แก่ท่าน และท่านต้องชำระเงินตามข้อกำหนดและเงื่อนไขในข้อที่ระบุ ในกรณีนี้ ท่านยอมรับและตกลงว่า สินค้าจะถูกส่งมอบให้แก่ท่านเมื่อการชำระเงินเสร็จสมบูรณ์

ง) หากท่านไม่สามารถชำระเงินภายในเวลาที่กำหนด ท่านตกลงว่า P2W อาจ, นอกเหนือจากสิทธิ์และทางเลือกทั้งหมดที่มีให้ตามที่ระบุในข้อกำหนดนี้หรือกฎหมาย, ยกเลิกหรือระงับสินค้าที่ได้รับผลกระทบ

6. การคืนเงิน

ธุรกรรมทั้งหมดที่ดำเนินการตามข้อกำหนดและเงื่อนไขเหล่านี้ถือเป็นที่สิ้นสุด สินค้าที่จัดจำหน่ายผ่าน P2W TOPUP อยู่ภายใต้นโยบายไม่คืนเงินอย่างเคร่งครัด โปรดตรวจสอบให้แน่ใจว่าสินค้านั้นเหมาะสมกับท่านก่อนทำการสั่งซื้อ ผู้ใช้ปลายทางต้องรับผิดชอบแต่เพียงผู้เดียวในการตรวจสอบว่าอุปกรณ์ของตนสามารถใช้งานร่วมกับสินค้าที่ซื้อได้ การซื้อสินค้าที่เป็นไอเทมเสมือนถือเป็นที่สิ้นสุด ไม่สามารถคืนเงินหรือคืนสินค้าได้ เราไม่รับคืนเงินหรือเปลี่ยนสินค้าในกรณีที่เกิดจากการกระทำของผู้ใช้ปลายทางเอง รวมถึงปัญหาด้านความเข้ากันได้ของอุปกรณ์ด้วย

7. การส่งเสริมการขายและส่วนลด

7.1 อาจมีคูปองส่วนลดหรือรหัสส่วนลด ("ส่วนลด") ที่แจกจ่ายให้แก่ผู้ใช้งานปลายทางบน P2W TOPUP โดยส่วนลดเหล่านี้ใช้ได้เฉพาะบน P2W TOPUP เท่านั้น และไม่สามารถโอนสิทธิ์หรือแลกเปลี่ยนเป็นเงินสดได้

7.2 P2W TOPUP สงวนสิทธิ์ในการเปลี่ยนแปลงข้อกำหนดเหล่านี้หรือยกเลิกการส่งเสริมการขายใด ๆ ได้ทุกเมื่อโดยไม่ต้องแจ้งให้ทราบล่วงหน้า และสามารถดำเนินการที่จำเป็นรวมถึงแต่ไม่จำกัดเพียงการถอนเงินสนับสนุนหรือเงินคืน การยกเลิกการส่งเสริมการขาย การเพิกถอนสิทธิ์ในโปรโมชั่น การยกเลิกรายการธุรกรรม การระงับเงิน การปิดบัญชี และการดำเนินการอื่น ๆ หากพบว่ามีการฉวยโอกาส การละเมิด หรือการใช้ส่วนลดเพื่อประโยชน์ส่วนตนของผู้ใช้งานปลายทาง รวมถึงมีพฤติการณ์บ่งชี้ถึงการฉ้อโกงหรือการละเมิดข้อกำหนดและเงื่อนไขของ P2W TOPUP และบทบัญญัติของกฎหมายที่มีผลใช้บังคับในประเทศไทย

7.3 อาจมีข้อกำหนดและเงื่อนไขเพิ่มเติมที่ระบุไว้สำหรับส่วนลดแต่ละรายการ (เช่น ระยะเวลา จำนวนส่วนลด วิธีการชำระเงิน และสินค้าที่ร่วมรายการ) ซึ่งข้อกำหนดเหล่านี้จะใช้ควบคู่กับข้อกำหนดในเอกสารฉบับนี้ในการควบคุมการใช้และการแลกรับส่วนลดนั้น ๆ

7.4 ในกรณีที่คำสั่งซื้อถูกยกเลิกหรือมีการคืนเงินหลังจากที่มีการใช้ส่วนลดแล้ว ผู้ใช้งานปลายทางจะได้รับเงินคืนเฉพาะในส่วนที่ชำระจริงเท่านั้น โดยส่วนลดที่ใช้ไปแล้วจะไม่สามารถขอคืน เปลี่ยนคืน หรือแลกรับได้อีกต่อไป

7.5 เราขอสงวนสิทธิ์ในการยกเลิกส่วนลดใด ๆ ที่มอบให้แก่ผู้ใช้งานปลายทาง หรือคำสั่งซื้อใด ๆ ที่มีความเกี่ยวข้องกับส่วนลดซึ่งได้รับจากหรือเป็นผลมาจากโปรแกรมส่งเสริมการขาย ตามดุลยพินิจของเราแต่เพียงผู้เดียวและโดยไม่ต้องแจ้งให้ทราบล่วงหน้า รวมถึงในกรณีที่เราพิจารณาโดยดุลยพินิจอย่างเด็ดขาดว่าผู้ใช้งานปลายทางดังกล่าวได้ละเมิดข้อกำหนดใด ๆ รวมถึงแต่ไม่จำกัดเพียง ข้อกำหนดการใช้งาน นโยบายความเป็นส่วนตัว และ/หรือ ข้อกำหนดและเงื่อนไขการขาย

7.6 เว้นแต่จะมีการระบุไว้เป็นอย่างอื่น ส่วนลดจะไม่สามารถใช้ร่วมกับโปรโมชั่นหรือส่วนลดอื่น ๆ ได้ ยกเว้นสินค้าที่มีการลดราคาไว้ล่วงหน้าบน P2W TOPUP

8. การเชื่อมโยงและการโฆษณา

8.1 เพื่อความสะดวกของคุณ เราอาจมีการแนบลิงก์ไปยังเว็บไซต์อื่นหรือเนื้อหาบนอินเทอร์เน็ตที่เป็นของหรือดำเนินการโดยบุคคลภายนอก เว็บไซต์หรือเนื้อหาที่เชื่อมโยงเหล่านี้ไม่ได้อยู่ภายใต้การควบคุมของเรา และเราจะไม่รับผิดชอบต่อข้อผิดพลาด การละเว้น ความล่าช้า การหมิ่นประมาท การใส่ร้าย ข้อมูลเท็จ เนื้อหาที่ไม่เหมาะสม ลามกอนาจาร คำหยาบ ความไม่ถูกต้อง หรือเนื้อหาไม่เหมาะสมอื่น ๆ ที่อยู่ในเนื้อหาเหล่านั้น หรือผลกระทบที่เกิดจากการเข้าถึงเว็บไซต์ที่เชื่อมโยงใด ๆ ทั้งสิ้น การมีลิงก์ไปยังเว็บไซต์หรือเนื้อหาอื่น ๆ ไม่ถือเป็นการรับรองหรือการตรวจสอบเว็บไซต์หรือเนื้อหานั้น ๆ และคุณตกลงว่าการเข้าถึงหรือใช้งานเว็บไซต์หรือเนื้อหาที่เชื่อมโยงดังกล่าวเป็นความเสี่ยงของคุณเองโดยสมบูรณ์

8.2 เราอาจติดแบนเนอร์ จาวาแอปเพล็ต และ/หรือสื่ออื่นใดบนเว็บไซต์เพื่อวัตถุประสงค์ในการโฆษณาสินค้าของเราหรือของผู้ขายของเรา เพื่อความชัดเจน คุณจะไม่มีสิทธิได้รับค่าตอบแทน ค่าธรรมเนียม และ/หรือค่านายหน้าใด ๆ อันเกี่ยวเนื่องกับการโฆษณาหรือสื่อส่งเสริมการขายเหล่านั้น

9. ข้อตกลงระดับการให้บริการ (Service Level Agreement)

ในการใช้งานผลิตภัณฑ์ที่ซื้อจาก P2W TOPUP หากผู้ใช้งานปลายทางพบปัญหาใด ๆ ผู้ใช้งานปลายทางจะต้องติดต่อสอบถามและร้องขอโดยตรงกับผู้ขาย และไม่ว่าในกรณีใด ๆ P2W TOPUP จะไม่รับผิดชอบต่อการละเมิดข้อตกลงระดับการให้บริการที่มีระหว่างผู้ใช้งานปลายทางและผู้ขาย

10. การชำระเงิน

เพื่อให้มีตัวเลือกวิธีการชำระเงินที่หลากหลายมากขึ้น P2W TOPUP ได้ร่วมมือกับบุคคลภายนอกเพื่ออำนวยความสะดวกให้แก่ผู้ใช้งานในการเลือกวิธีการชำระเงินที่ตรงกับความต้องการของตนเอง โดยบริการรับชำระเงินและจัดเก็บเงินจะดำเนินการโดยผู้ให้บริการบุคคลที่สาม

11. ภาษี

ค่าธรรมเนียมทั้งหมดไม่รวมภาษี ซึ่งเราจะเรียกเก็บตามที่กฎหมายกำหนด โดยคุณจะต้องรับผิดชอบในการชำระภาษีใด ๆ ที่รัฐบาลเรียกเก็บจากการใช้งาน P2W TOPUP ของคุณ รวมถึงแต่ไม่จำกัดเพียง ภาษีขาย ภาษีการใช้ หรือภาษีมูลค่าเพิ่ม และค่าธรรมเนียมที่คล้ายกันทั้งหมด (เรียกรวมกันว่า "ภาษี")

12. ข้อจำกัดความรับผิดในเรื่องการรับประกัน

13. การชดใช้ค่าเสียหาย

คุณตกลงที่จะชดใช้ค่าเสียหายและปกป้อง P2W และบริษัทในเครือ เจ้าหน้าที่ ตัวแทน พนักงาน และผู้จัดหา ผู้ให้สิทธิ์ใช้งาน และพันธมิตรภายนอกของ P2W จากข้อเรียกร้อง ความสูญเสีย ความเสียหาย ความรับผิด รวมถึงค่าทนายความและค่าใช้จ่ายทางกฎหมายที่เกิดขึ้นจากการใช้หรือการใช้ผิดวัตถุประสงค์ของคุณต่อ P2W TOPUP หรือผลิตภัณฑ์ใด ๆ การละเมิดข้อกำหนดเหล่านี้ หรือการละเมิดคำรับรอง การรับประกัน หรือพันธสัญญาใด ๆ ของคุณ

14. ข้อจำกัดความรับผิด

14.1 P2W TOPUP ไม่รับประกันว่า (1) บริการของ P2W TOPUP จะตรงตามความต้องการของผู้ใช้งานเสมอไป หรือสามารถเข้าถึงได้ตลอดเวลา; (2) บริการของ P2W TOPUP จะไม่ถูกรบกวน ตรงต่อเวลา ปลอดภัย และปราศจากข้อผิดพลาดใด ๆ; (3) ผลลัพธ์ที่ได้จากการใช้งานจะถูกต้องหรือเชื่อถือได้เสมอไป; (4) คุณภาพของผลิตภัณฑ์ บริการ ข้อมูล หรือเนื้อหาอื่นใดที่ซื้อหรือได้รับผ่านบริการของ P2W TOPUP จะตรงตามความคาดหวังของผู้ใช้งานเสมอไป

14.2 ผู้ใช้งานปลายทางจะต้องรับผิดชอบและรับความเสี่ยงทั้งหมดที่เกี่ยวข้องกับเนื้อหา ภาษา และแอปพลิเคชันที่ได้ส่งหรือเผยแพร่โดยสมัครใจให้แสดงผลผ่านบริการของ P2W TOPUP ในกรณีที่ผู้ใช้งานปลายทางละเมิดสิทธิส่วนบุคคล เช่น แต่ไม่จำกัดเพียง การละเมิดสิทธิในทรัพย์สินทางปัญญา การเจาะระบบ การใช้บัญชีในทางที่ผิด หรือความประมาทเลินเล่อของผู้ใช้งานปลายทางเอง ผู้ใช้งานปลายทางจะต้องรับผิดชอบต่อการละเมิดดังกล่าวแต่เพียงผู้เดียว และต้องปกป้อง P2W TOPUP จากข้อเรียกร้องใด ๆ ที่เกิดขึ้นจากบุคคลภายนอก

14.3 เพื่อให้มีทางเลือกด้านวิธีการชำระเงินที่หลากหลายมากยิ่งขึ้น P2W TOPUP ได้ร่วมมือกับบุคคลภายนอกเพื่ออำนวยความสะดวกให้แก่ผู้ใช้งานปลายทางในการเลือกวิธีการชำระเงินที่ตรงตามความต้องการ ดังนั้น ในกรณีที่มีความไม่ตรงกันและ/หรือข้อผิดพลาดในระบบหรือการใช้งานของวิธีการชำระเงินที่จัดให้โดยพันธมิตรด้านการชำระเงิน ผู้ใช้งานปลายทางสามารถยื่นเรื่องร้องเรียนโดยตรงกับพันธมิตรด้านการชำระเงินนั้น และขอยกเว้นความรับผิดชอบของ P2W TOPUP ในการชดเชยความเสียหายที่เกิดขึ้นจากข้อผิดพลาดของพันธมิตรด้านการชำระเงินดังกล่าว

15. ระยะเวลาและการยกเลิกบริการ

15.1 ผลจากการยกเลิกบริการ: เมื่อบริการหมดอายุหรือสิ้นสุดไม่ว่าด้วยเหตุผลใดก็ตามตามที่ระบุไว้ในข้อกำหนดและเงื่อนไขฉบับนี้ คุณจะต้องยุติการใช้งานบริการดังกล่าว และ P2W TOPUP จะยุติการให้บริการนั้นเช่นกัน ในกรณีที่มีการยกเลิกบริการ P2W TOPUP จะไม่คืนค่าธรรมเนียมล่วงหน้าที่คุณได้ชำระไว้สำหรับผลิตภัณฑ์ที่ซื้อ และคุณจะต้องรับผิดชอบในการชำระเงินที่ค้างอยู่ P2W TOPUP อาจยกเลิกบริการนี้และการสมัครสมาชิกบริการใด ๆ ได้ทุกเมื่อ ไม่ว่าจะมีเหตุผลหรือไม่มีเหตุผล โดยไม่ต้องแจ้งให้คุณทราบล่วงหน้า

16. การบังคับใช้

ผู้ใช้งานปลายทางตกลงและยอมรับในการเก็บรวบรวม การใช้ และการเปิดเผยข้อมูลส่วนบุคคล โดยที่ P2W จะดำเนินการเก็บรวบรวม จัดเก็บ และใช้ข้อมูลส่วนบุคคลของผู้ใช้งานปลายทางเพื่อวัตถุประสงค์ในการให้บริการที่ผู้ใช้งานปลายทางได้เข้าใช้ และให้เป็นไปตามกฎหมาย ดังต่อไปนี้:

1. "ข้อมูลส่วนบุคคล" หมายถึง ชื่อ-นามสกุลของผู้ใช้งานปลายทาง ที่อยู่ ข้อมูลทางการเงิน ข้อมูลการทำธุรกรรม ข้อมูลด้านสุขภาพ ข้อมูลชีวภาพ (เช่น ลายนิ้วมือ การจดจำใบหน้า เป็นต้น) ความพิการ และ/หรือข้อมูลอื่นใดที่เหมาะสมสำหรับการให้บริการ ซึ่งเกี่ยวข้องกับการระบุตัวตนของผู้ใช้งานปลายทาง ไม่ว่าจะสามารถระบุได้โดยตรงหรือโดยอ้อม ซึ่งผู้ใช้งานปลายทางได้ให้แก่ P2W หรือที่ P2W ได้รับหรือเข้าถึงจากแหล่งข้อมูลอื่น

2. P2W จะทำการเก็บรวบรวม จัดเก็บ และใช้ข้อมูลส่วนบุคคลของผู้ใช้งานปลายทางเพื่อวัตถุประสงค์หรือกิจกรรมที่ผู้ใช้งานปลายทางอาจมีความสนใจ ซึ่งเกี่ยวข้องกับบริการโทรคมนาคม บริการกระจายเสียง บริการการชำระเงิน หรือบริการอื่น ๆ บริการดิจิทัล การวิจัยการตลาดและการสำรวจ กิจกรรมส่งเสริมการขาย การให้สิทธิพิเศษตามความชอบหรือการวิเคราะห์ข้อมูลของผู้ใช้งานปลายทาง เพื่อเสนอสินค้า หรือบริการของ P2W และ/หรือบุคคลที่เป็นผู้จัดจำหน่าย ตัวแทน หรือบุคคลที่เกี่ยวข้อง หรือบุคคลอื่น ๆ หรือภาระผูกพันทางกฎหมายหรือข้อบังคับที่ P2W ต้องปฏิบัติตามไม่ว่าจะเป็นในปัจจุบันหรือในอนาคต รวมถึงการอนุญาตให้ P2W ส่ง ถ่ายโอน และ/หรือเปิดเผยข้อมูลส่วนบุคคลไปยังผู้รับข้อมูลที่เป็นบริษัทในกลุ่มธุรกิจของ P2W พันธมิตรทางธุรกิจ องค์กร หรือบุคคลนิติบุคคลที่มีสัญญาหรือความสัมพันธ์ทางกฎหมายกับ P2W โดยอนุญาตให้ P2W ส่ง ถ่ายโอน และ/หรือเปิดเผยข้อมูลดังกล่าวทั้งภายในประเทศและต่างประเทศ P2W จะเก็บรักษาข้อมูลส่วนบุคคลของผู้ใช้งานปลายทาง หากจำเป็นและเพื่อวัตถุประสงค์ตามที่กล่าวมาเท่านั้น โดยผู้รับข้อมูลดังกล่าวก็มีภาระผูกพันทางกฎหมายในการเก็บรักษาข้อมูลส่วนบุคคลเช่นกัน หากมีการปรับปรุงวัตถุประสงค์ในการเก็บรวบรวมข้อมูลส่วนบุคคลในภายหลัง P2W จะแจ้งให้ผู้ใช้งานปลายทางทราบ

3. ผู้ใช้งานปลายทางมีสิทธิ์ที่จะถอนการให้ความยินยอมในการเก็บรวบรวมข้อมูลส่วนบุคคลของตนได้ทุกเมื่อ ยกเว้นกรณีที่การถอนการยินยอมดังกล่าวส่งผลกระทบต่อบริการหรือเกินขอบเขตที่ P2W สามารถควบคุมได้

1. Definitions

4. P2W TOPUP User Account

4.1 End User hereby declares that the End User is a capable person and is capable of binding himself in a legal agreement.

4.2 P2W TOPUP does not charge End User for registering to P2W TOPUP Service.

4.3 You must create your user account with an active Thai mobile number or email address and complete all verification prior to completing any Order on P2W TOPUP.

4.4 You agree that P2W may disclose and share your information on P2W TOPUP to relevant third-party as part of providing the Service to you.

5. Terms for Sale of Products

5.1 You acknowledge that P2W neither directly sell nor own any Product on the Site, and is only facilitating the Sale of Products by the Seller to the End User. The name of the Seller of the Product is publicly displayed on the Site.

5.2 Your authorization to use any Products is provided by the Seller and not P2W, and is subject to any terms and conditions of services as made available by the Seller, including, but not limited to, warranties (if any), ownership of intellectual property and permitted uses. Each agreement entered into for the Sale of Products to an End User shall be an agreement entered into directly and only between the Seller and the End User and also subjected to the Terms and Conditions of Sale listed here.

5.3 You acknowledge and agree that You must contact the respective Seller or its designated representative with regards to any service issues, including any issues with support. P2W provides customer support to You at no additional fee for service issues related to the use of the P2W TOPUP.

5.4 Product Description:

a) While we endeavor to provide an accurate description of the Products on Product Detail Page, we do not warrant that such description is accurate, current or free from error.

5.5 Prices of Products:

a) All Product Prices are subject to taxes, unless explicitly stated otherwise.

b) We, as notified and requested by the Seller, reserve the right to amend the Prices at any time without giving any reason or prior notice.

5.6 Order Placement:

6. Refunds

All virtual item purchases are final, non-refundable and non-returnable. 7. Promotion and Discounts

7.1 There may be promotional discount coupons and discount codes ("Discounts") distributed to the End User on P2W TOPUP. These Discounts are valid only on the P2W TOPUP and cannot be transferable or exchangeable for cash.

7.2 P2W TOPUP reserves the right, without prior notice, to change these terms or cancel any promotions at any time and to take necessary actions including but not limited to withdrawing subsidies or cashback, canceling promotion, revoking promotion, canceling transactions, holding funds, closing accounts, and other things if there is found manipulation, violation or utilization of the Discounts for the personal benefit of the End User, as well as an indication of fraud or violation to P2W TOPUP Terms and Conditions and legal provisions that apply in Thailand.

7.3 Additional terms and conditions may be specified in relation to specific Discounts (for example, duration, discount amount, payment method and products covered), and will govern the use and redemption of those Discounts in addition to these terms.

7.4 In the event where the Order is canceled or refunded after the Discounts have been redeemed, the End User will receive a refund only of the amount actually paid. Discounts used cannot be refunded, returned or redeemed anymore.

7.5 We reserve the right to cancel any Discounts awarded to an End User or Orders placed in connection with any Discounts that were obtained under or as a result of the promotional program at its sole discretion and without prior notice including the case that where we determine in its sole and absolute discretion that such End User has breached any terms including but not limited to the Terms of Use, Privacy Policy and/or the Terms & Conditions of Sale.

7.6 Unless otherwise stated, Discounts are not valid in conjunction with other tactical promotions or discounts, with the exception of pre-discounted products on P2W TOPUP.

To the extent permitted by law, the Site and all services provided by P2W TOPUP are provided to you "as is" and "as available" without warranty or condition of any kind, either express or implied, including, but not limited to, the implied warranties and conditions of merchantability, or non-infringement.

P2W TOPUP makes no other representations, promises, warranties or understandings of any kind relating to the Site, services, including third party services, or content under this agreement. P2W TOPUP shall not be liable to you, your customers or any third party for any claim or liability arising from or relating to your use of the intellectual property, the services, including third party services, the Site, or from the manufacture, use, importation or sale of the services, or for any claim for loss of profits, loss or interruption of business, or for indirect, special, exemplary, punitive, or consequential damages of any kind.

13. Indemnity

You agree to indemnify and hold P2W and its affiliates, officers, agents, and employees, agents and its third party suppliers, licensors and partners harmless from any claims, losses, damages, liabilities, including legal fees and expenses, rising out of Your use or misuse of the P2W TOPUP or any Products, Your violation of these Terms, or any breach of your representations, warranties, and covenants.

14. Limitation of Liability

14.1 P2W TOPUP does not guarantee that (i) P2W TOPUP Services will always meet user needs or will always be accessible; (ii) P2W TOPUP Services will not be disturbed, timely, safe and free from any errors; (iii) The results obtained will always be accurate or reliable; (iv) the quality of each product, service, information or other material purchased or obtained through P2W TOPUP Services will always meet user expectations.

14.2 End User is responsible for and bears all risks to the content, language and applications that are consciously submitted so that they are available and displayed for P2W TOPUP Services. In the event of a personal violation by an End Users such as but not limited to IPR infringement, system manipulation, account misuse or other End User's negligence, End User is personally responsible for the violation and shall exclude P2W TOPUP from claims arising from third parties.

14.3 In order to provide a more varied payment method, P2W TOPUP collaborates with other parties to make it easier for End Users to choose the payment method that suits their needs. Therefore in the event that there is a discrepancy and/or error in the payment method provided by the payment partner, both in the system and its usage, the End Users can directly file a complaint with the payment partner and hereby release the P2W TOPUP from the responsibility to provide compensation for losses incurred due to the error of the payment partner.

15. Term and Termination

a) Effect of termination of Service: Upon expiration or other termination of the Service(s) for any reason as permitted in this Terms and Conditions, You must stop using, and P2W TOPUP will stop providing, the terminated Service(s). In the event of such termination, P2W TOPUP will not refund any prepaid fees for Products purchased and You will be responsible for payment. P2W TOPUP may terminate this Service and any Service subscription at any time for any reason, or no reason, without providing any advance notice to You.

b) Survival: Upon termination of Service(s) for any reason, You agree that You will immediately pay all amounts owed to P2W TOPUP. Any provision required by its construction or required for rights and obligations enforcement, shall survive termination, including, but not limited to, the payment provision, the indemnity provisions, limitations of liability and the survival terms and this Section 17 (Term and Termination).

16. Enforceability

In the event that any provision of these Terms and Conditions are unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render this Terms and Conditions unenforceable or invalid as a whole. P2W will amend or replace such provision with one that is valid and enforceable, and which achieves, to the extent possible, our original objectives and intent as reflected in the original provision.

17. Personal Data Collection

End User hereby provides consent to P2W TOPUP for the collection of personal subject to the Attachment A: Terms for Collect, Use and Disclose of Personal Data.

Attachment A: Terms for Collect, Use and Disclose of Personal Data

End User hereby agrees and accepts to the collection, usage and disclosure of Personal Data in which P2W shall collect, store, use of End User's Personal Data for the purpose of Service in which the End User has accessed and in accordance with the law as follows:

1. "Personal Data" means End User's full name, address, financial information, transaction information, health information, biological information (e.g. fingerprint, face recognition and etc.) disabilities and/or other information, which is appropriate for providing service, related to the identifiable of End User whether can be identified directly or indirectly in which End User has provided to P2W or P2W has received or accessed from other sources.

2. P2W shall collect, store, use of End User's Personal Data for the purpose or activity which End User may be interested in relating to telecommunication service, broadcasting service, payment service or other services, digital service, marketing research and survey, promotional activities, providing privilege based on End User's preferences or data analysis in order to offer goods or services of P2W and/or a person who is a distributor, agent, or the person who related thereof, and/or other person, or legal obligations or regulation to which P2W is subject whether present or in the future, including permission P2W to send, transfer and/or disclose personal data to the recipient that is a company within P2W's business group, business alliance, organization or juristic person who has a contract or a legal relationship with P2W by allowing P2W to send, transfer and/or disclose such information through domestically and internationally. P2W shall retain End Users' Personal Data, if necessary and only for the above-mentioned purposes, where the recipient is also obligated by law to retain Personal Data as well. If there is a later update in the purpose of collecting Personal Data, P2W will inform the End User.

3. The End User has the right to withdraw End Users' Personal Data at any time, unless such withdrawal affects the Services or is beyond P2W's control.

4. Terms for the collection, usage and disclosure of Personal Data shall be effective for a period specified by law.

5. End User's right to withdraw, access or request for copy of Personal Data, objection to the collection, usage or disclosure, rights to data portability, rights to erasure, rights to suspend the use of Personal Data shall be in accordance with our privacy policy, and others as specified by law.
